By downloading or using the Underpebble mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms apply to all users of the App. We may update these Terms from time to time and will notify you of material changes by updating the "Last updated" date above. Continued use of the App after any changes constitutes your acceptance of the new Terms.
2. Description of Service
Underpebble is a micro-adventure generator that provides daily outdoor activity suggestions ("nudges") for families. Suggestions are generated algorithmically based on factors such as local weather conditions, time of day, and equipment preferences you configure in the App.
The App is provided free of charge and is intended for personal, non-commercial use. We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without notice.
3. Outdoor Activity Disclaimer
Participating in outdoor activities involves inherent risks, including the risk of injury or death. Underpebble provides activity suggestions for informational and inspirational purposes only. We do not assess the physical capabilities, fitness level, or experience of individual users.
You are solely responsible for:
- Evaluating whether any suggested activity is appropriate for you and your family
- Ensuring that all participants are physically capable of completing the activity
- Following all applicable laws, regulations, and safety guidelines
- Using appropriate safety equipment and protective gear
- Supervising children at all times during outdoor activities
- Assessing local conditions including weather, terrain, and wildlife
Always prioritize safety. If an activity does not feel safe, do not attempt it.
4. User Responsibilities
You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
- Reverse engineer, decompile, or disassemble the App
- Use the App to generate, distribute, or store unlawful content
- Interfere with or disrupt the integrity or performance of the App
- Attempt to gain unauthorized access to any systems connected to the App
5. Intellectual Property
All content, features, and functionality of the App — including but not limited to text, graphics, icons, and software — are the exclusive property of Underpebble and its licensors and are protected by applicable intellectual property laws.
These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNDERPEBBLE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDERPEBBLE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO BODILY INJURY, PROPERTY DAMAGE, LOSS OF DATA, OR LOSS OF PROFITS — ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP OR ANY ACTIVITY SUGGESTED BY THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Third-Party Services
The App may use third-party services such as OpenWeather for weather data. These services are governed by their own terms of service and privacy policies. Underpebble is not responsible for the practices of any third-party services.
9. Children
The App is designed for use by families and may be used by children under parental supervision. We do not knowingly collect personal information from children under the age of 13. The App does not require account creation and stores all data locally on your device.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
